All policies, warranties, terms & conditions shall supersede any subsequent terms or conditions included with any order placed with Tierravision Inc. ('Tierravision'), who also reserves the right to make changes to this site and their printed materials regarding these terms and conditions at any time without notice.
Your emailed receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Item availability and prices are subject to change at any time, without notice. Tierravision reserves the right to limit quantities, and to decline the acceptance of any order for any reason. Tierravision reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity ordered of any item.
An order may be canceled only if that item is backordered and not available to ship or download. Any order submitted through this web-site, if in stock, will ship immediately and cannot be cancelled. A notification will be sent via email when an order is cancelled. Tierravision reserves the right to cancel an order or to issue a Return Merchandise Authorization (RMA) for merchandise that is advertised in error, which does not conform to advertised specifications, or was shipped in error. Charge backs from credit card issuing banks are subject to the above policies.
Items are usually in stock at all times, but in the event of a shipment delay or other unforeseeable delay, Tierravision will place the item(s) on backorder and ship you when it becomes available. On orders with backordered items, the total shipping charges are included with the first shipment. Shipping charges are non-refundable. A backorder may be cancelled at any time prior to shipping.
Tierravision charges sales tax on all shipments to the state of California. If your package ships from a distribution center in the state in which you reside, a sales tax may apply. You, the customer, are responsible for any and all unpaid sales taxes.
Tierravision accepts all major credit cards & PayPal and there is no surcharge for using your credit card to make a purchase. Please be sure to provide the exact billing address and telephone number as recorded with your credit card issuing bank. We will ship to an alternate address only if the address is on file with your credit card issuing bank. Incorrect information may cause a delay in the processing of your order. Your credit card will be charged as each item is shipped.
All requests for technical service and support should be made directly to the manufacturer or service provider in accordance with their terms and conditions. Tierravision will provide on-line technical notes on some of the GPS hardware and software products it retails for your reference. Tierravision makes no guarantees of product reliability or compatibility. All compatibility-related questions must be directed towards the product manufacturer or software provider.
Worldwide copyright laws and treaty provisions protect all materials appearing anywhere on Tierravision's website. None of these materials may be copied, reproduced, modified, or distributed in any form or by any other means without the written consent of Tierravision. Any unauthorized use of the materials appearing on Tierravision's website may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

Any litigation regarding this agreement or any transaction between a customer and Tierravision shall be brought to the state or federal courts located in San Diego County, California and customer hereby agrees and submits to such jurisdiction and venue as proper.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Tierravision shall have the right to refuse or cancel any orders placed for products listed at the incorrect price without prior notification. Tierravision shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and the order is canceled, Tierravision shall immediately issue a credit to the credit card account in the amount of the incorrect price.
All orders shipped within the Continental US will usually ship within 48 business hours (this will exclude Saturdays, Sundays and holidays). Next day orders receive priority and are usually shipped the same day if received before 1:00 p.m. PST. For multiple item orders, shipping charges will be calculated based on the total weight and ship-to location. Applicable taxes for California residents only will be added to the sales price. All applicable local, state, federal, and international taxes and duties are the sole responsibility of the customer. Tierravision does not have any control or influence in this matter. Your completed purchase confirms full acknowledgement of this issue.

Shipments outside of the Continental United States must be made by UPS International Expedited Service or USPS Global Express Service to avoid most international taxes or tariffs.

Except as provided herein, Tierravision makes no express warranties', including but not limited to any warranties of merchantability or fitness for particular use, or non-infringement. You acknowledge that your use of the product, or service, is at your own sole risk and that you agree the information provided are without warranty of any kind.
Under no circumstances, including negligence, will Tierravision or any of its affiliates, it's directors, officers or employees, resellers, dealers, distributors, or any third party be liable for any direct, indirect, incidental, special or consequential damages that results from your use, or your inability to use, or the performance of the product(s) with respect to any liability, loss, or arising out of any breach of this warranty, including, but not limited to any damages resulting from inconvenience, loss of time, data, property, revenue, or profit or any indirect, special incidental or consequential damages. You acknowledge that this limitation applies to all content information or other services available from Tierravision and whether or not Tierravision has notice of the possibility of such damages, and whether or not to circumstances giving rise to such damages may have been within the control of Tierravision.
Some states do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In those states, liability is limited to the fullest extent allowed by law. By using the product(s), you agree to indemnify Tierravision and its parents, subsidiaries, affiliates, officers and employees and hold them harmless from any and all claims and expenses, including reasonable attorney's fees, asserted third party due to, or arising out of your use of the products, services and their web-sites.
We want you to have an outstanding purchasing experience with Tierravision. Therefore, we will make all attempts to resolve your concerns with your purchased product.
Please send all GPS hardware product returns to the original GPS equipment manufacturers or website in accordance with their return policies.
*Note: All Software sales are final and non-refundable, no exceptions. Tierravision has 14-day free trials for all of its software titles.

Refunds are given in the same form of payment originally used for purchase. Upon approval of a refund, please delete the application, all of its components, any registration codes, and fully downloaded versions from your handheld and/or computer. By receipt of a refund, you are agreeing to remove the software.
Tierravision will, at its option, unless otherwise provided by law correct any defect found in its software.
NOTE: Additional products bundled with our hardware which are not manufactured Tierravision may hold separate warranties as expressed by the individual manufacturer of those product(s). Product specifications, functions and features are subject to change without notice and Tierravision cannot be held liable for any omissions and/or errors in printed materials or posted electronic materials. This warranty gives you specific legal rights, and you may also have other rights, which may vary from state to state.

At Tierravision, Inc, we value your privacy. Your personal information is for use by Tierravision's staff only. This information is kept on a secure server to protect it from outside parties, and is information used for the limited purpose of processing your order(s).
